1. Introduction

Welcome to BrewCall AI ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the BrewCall AI platform, including our website, mobile applications, and AI-powered phone ordering system (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

BrewCall AI provides an AI-powered phone ordering system for coffee shops. Our Service allows coffee shops to receive and process customer orders placed via phone calls using our artificial intelligence technology.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Coffee Shop Owner Responsibilities

If you register as a coffee shop owner, you are responsible for:

  • Providing accurate menu information, including prices and availability
  • Fulfilling orders placed through our Service
  • Ensuring the quality and safety of products sold
  • Complying with all applicable laws and regulations related to food service, taxation, and business operations
  • Maintaining appropriate business licenses and permits

5. AI Voice Technology

Our Service uses AI voice technology to answer phone calls and process orders. By using our Service, you acknowledge and agree that:

  • Calls may be recorded for quality assurance and training purposes
  • AI transcriptions may not be 100% accurate
  • You are responsible for reviewing and confirming orders processed by our AI system
  • You will inform your customers that they are interacting with an AI assistant

6. Payment and Fees

We offer various subscription plans for our Service. By selecting a paid subscription, you agree to pay all fees in accordance with the pricing and payment terms presented to you.

All fees are exclusive of taxes, which you are responsible for paying. Fees are non-refundable except as required by law or as explicitly stated in these Terms.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by BrewCall AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, create derivative works, publicly display, publicly perform, republish, or transmit any material from our Service without our prior written consent.

8. User Content

You retain all rights to any content you submit, post, or display on or through the Service ("User Content"). By providing User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your User Content in connection with the Service.

You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third party's intellectual property or other rights.

9. Prohibited Uses

You agree not to use the Service:

  • In any way that violates any applicable law or regulation
  • To transmit any material that is defamatory, obscene, or offensive
  • To impersonate or attempt to impersonate another person or entity
  • To engage in any activity that interferes with or disrupts the Service

10. Limitation of Liability

To the maximum extent permitted by law, BrewCall AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, resulting from your use of the Service.

11. Indemnification

You agree to indemnify and hold harmless BrewCall AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
